I guess this means that a landowner could ostensibly grant passage  
along his side of the river, outside the navigation channel, and  
charge a toll for that passage. Taxes would have to be paid on that  
toll, thereby benefitting the US Treasury.

What a grand idea! "Boat on 'my' river, and reduce the federal deficit!"

Now, if I can get my local Fed. judge to do the same for the section  
of the highway, outside the travel lanes, in front of my house, I  
could charge a toll to all the walkers, bikers, skaters and roaming  
dogs and make a nice additional income.

Somehow I don't think it would fly here in New England.
