Looks to me like the Auxiliary vessel was the give way since the other one
was in his danger zone, and it looks like the auxiliary vessel should have
made the moves.  This is a case just like the danger zone simulator in the 
Boating Course teaching materials. I would fault the auxiliary vessel in
this case. Perhaps the "skipper" was too busy yelling on his loud hailer to
respond properly to the situation!

Note that there was no 5 blast horn / whistle signal and that the  
"give way" vessel did not slow or change its course!
